Terms of Use

1. Prohibited Uses: Artificial Intelligence, Machine Learning, and Web Scraping

Except as expressly authorised by us in writing, you are strictly prohibited from using, copying, downloading, extracting, or harvesting any content, text, data, images, or source code from this website (https://arabellatresilian.com – the “Site”) for any purpose related to artificial intelligence, machine learning, or automated data extraction.

Prohibited activities include, but are not limited to:

Training and Development: Using any portion of the Site’s content to train, fine-tune, test, validate, or otherwise develop machine learning models, large language models (LLMs), neural networks, generative AI systems, or similar technologies.

Automated Extraction: Employing any automated systems, devices, algorithms, spiders, robots, scrapers, crawlers, or screen-scraping tools to access, acquire, or monitor any part of the Site.

Derivative Works: Using the Site’s intellectual property to generate derivative content, synthetic data, or automated summaries via artificial intelligence systems.

2. Express Reservation of Rights & Machine-Readable Opt-Out

We expressly reserve all rights to our content for the purposes of text and data mining, machine learning, and AI training under all applicable global copyright laws, including but not limited to the UK Copyright, Designs and Patents Act 1988, and Article 4(3) of the European Union Digital Single Market Directive (Directive (EU) 2019/790).

This reservation of rights applies to all content on this Site, including text, photographs, layouts, and software.

For the avoidance of doubt, our lack of consent is signified both by these Terms of Use and through machine-readable means. We consider any circumvention of technological measures (such as firewalls, CAPTCHAs, or blocking parameters in our robots.txt or .well-known/tdmrep configurations) to be a material breach of these Terms.

3. Enforcement and Remedies

Any unauthorised scraping or use of our content for AI training constitutes a breach of contract, a violation of our intellectual property rights, and potentially an unauthorised access of our systems. We reserve the right to deploy technical measures to block any IP address, automated agent, or user profile found violating these terms, and to pursue full legal remedies, including injunctive relief and monetary damages, against violating individuals or entities.
